Tents & Accessories Care: The tent furnished hereunder by Service Direct shall remain the property of Service Direct; however, Customer acknowledges that it has care, custody and control of the tents & accessories while at the customer’s location. Customer accepts responsibility and agrees to pay for any loss or damage to the Tent (except for normal wear and tear or for loss or damage resulting from Service Direct’s handling of the items) and for its contents. Customer agrees not to move or alter the tent, and shall use the tent only for its proper and intended purpose. Customer agrees to indemnify, defend and hold harmless Service Direct against all claims, damages, suits, penalties, fines and liabilities for injury or death to persons or loss or damage to property arising out of Customer’s use, operation or possession of the tent.

Inspection: Customer shall inspect the tent upon arrival and immediately notify Service Direct in writing of any objection to or defect in the tent. Customer’s failure to do so shall constitute an acceptance of the tent “as is” and an acknowledgement that the tent is in good repair and in a safe usable condition. Upon timely receipt of notice of legitimate objection or defect, Service Direct shall, within a reasonable time, reasonably fix the problem.

Delivery/Pickup Service: Delivery service is available on all orders regardless of size. Additional delivery charges will occur for 2nd floor or higher delivery locations, excessive distance for loading and unloading trucks, specific delivery and pickup times, and after-hours delivery and pickup. Delivery fees quote may change after site inspection.

All items will be delivered and picked up at a designated location. The client should be available to count all items upon delivery and pickup, otherwise, the counts will be considered accurate. Orders are typically delivered 1-3 days in advance of your event while pickups occur 1-2 days following your event. Responsibility of tents & other accessories will remains with the client from the time of delivery to the time of pickup. Please be sure all items are secured when not in use and protected from the weather.

Cleanup/Preparation for Pickup: All floral arrangements, trash, and decorations of any kind should be removed from tent before scheduled pickup time. Client assumes responsibility for all damages caused by decorations. Please be aware that some decorations can cause a permanent station on the tent, linen, and other rental items. Please ask if you are unsure to avoid the cost of damages. Decorations must not affect the structural integrity of the tent. All chairs and tables should be stacked as delivered.

All dishes, glassware and cooking equipment should be returned to proper rack or container and assembled at a single location for pickup. Dishes, glassware, and flatware must be well rinsed and food and particle-free. Stoves, oven, and grills must be returned clean.

Access: Customer agrees to provide unobstructed access to the tent on the scheduled pickup day. If the tent inaccessible and the scheduled pick up cannot be made, Service Direct will promptly notify the Customer and afford the Customer a reasonable opportunity to provide the access and reschedule the service; however, Service Direct will charge an additional fee for Customer’s failure to provide initial access.

Reserving Tents & Accessories: Quotes and proposals do not guarantee availability of tents & accessories. Tents and items will be reserved only upon receipt of a valid credit card, a signed rental contract and a 50% NON-REFUNDABLE deposit.

Charges & Payment: Customer shall pay Service Direct for cancellation fee, Trip charges or Relocation charges or delays from the customer’s end at the time of delivery/setup or removal, that were not prepaid by Customer, in accordance with the schedule of charges.

Cancellations: Service Direct will charge full amount if order is cancelled 3 days prior to delivery, 75% non-refundable deposit if cancelled for any reason within 4-6 days prior to delivery, 50% non-refundable deposit if cancelled for any reason within 7-10 days prior to delivery. To receive full refund order may be cancelled 60 days prior to delivery.

Weather: Client understands that tent are temporary structures designed to provide limited protection from weather conditions, primarily sun and rain; however there may be situations, particularly those involving strong winds and lightning, in which tents will not provide protection and may even be damaged or blown over. Evacuation of tents to avoid possibly injury is recommended when severe weather threatens the area where the tent is erected. People must leave the tents and not seek shelter in tents during such conditions.

Damages/Incidentals/Fees: A card is kept on file through our secure merchant account for any damages/incidentals or extra fees (such as stand by fees). Service direct has the right to charge the card if rental equipment comes back damaged; stolen/missing equipment; or any standby/added services not on the original invoice. Service Direct will invoice you separately.

Disclaimer: Due to uncertain soil conditions and sub surface terrain, Service Direct cannot be held responsible for any damage to customer driveways, curbs, lawns or walks, wells and septic systems. It is the customer's responsibility to make Service Direct aware of any underground utilities, which might be affected by taking delivery of the tent. Every effort will be made to deliver/pickup a tent within 8 hours, 5 days a week. However, due to inclement weather, traffic conditions or mechanical breakdowns, delivery times or dates could vary. We will promptly contact you if there are delays in delivery or pickups.

Excused Performance: Neither party hereto shall be liable for its failure to perform or delay performance hereunder due to circumstances or the significant threat of circumstances beyond its reasonable control, whether foreseeable or not, including, but not limited to strikes, labor trouble, riots, compliance with laws or government orders, acts of war or terrorism, inability to access container, fires, and acts of god and such failure shall not constitute a default under this agreement.

Attorney Fees: In the event of breach of the Agreement by either party, the breaching party shall pay all reasonable attorney’s fees and costs of the other party incident to any action brought to enforce this Agreement. In the event Customer fails to pay Service Direct all amounts which become due under this Agreement, Customer agrees to pay, in addition to the amount due, any and all costs incurred by Service Direct as a result of such failure to pay, and including to the extent permitted by law, reasonable attorney fees.
